Trading foreign exchange (Forex), gold (XAUUSD), indices, cryptocurrencies, and other financial instruments on margin carries a HIGH LEVEL OF RISK and may not be suitable for all investors. You could sustain a loss of some or all of your invested capital. You should not invest money that you cannot afford to lose.

1. General Trading Risk

Trading leveraged financial instruments involves substantial risk of loss. The high degree of leverage can work against you as well as for you. Before deciding to trade, you should carefully consider your investment objectives, level of experience, and risk appetite.

Leverage Risk: Leverage amplifies both profits and losses. A small market movement can result in proportionally large losses exceeding your initial deposit
Market Risk: Markets can experience rapid, unpredictable movements due to economic events, geopolitical developments, natural disasters, or other factors beyond anyone's control
Liquidity Risk: During periods of extreme volatility or low liquidity, you may be unable to execute trades at desired prices, resulting in slippage or gaps
Counterparty Risk: Your broker may experience financial difficulties, technical failures, or regulatory issues that affect your ability to trade or access your funds
Currency Risk: If you trade instruments denominated in a currency other than your account currency, exchange rate fluctuations may affect your profits and losses

2. No Guarantee of Profit or Performance

EADECK MAKES ABSOLUTELY NO GUARANTEES, PROMISES, SUGGESTIONS, OR REPRESENTATIONS THAT ANY PRODUCT WILL PRODUCE PROFITS OR PREVENT LOSSES.

Specifically:

Past performance is NOT indicative of future results. Historical backtests, optimization results, and demo trading results have inherent limitations and do not represent actual live trading conditions
Backtesting limitations: Backtests use historical data and cannot account for future market conditions, changes in liquidity, changes in broker execution, regulatory changes, or black swan events
Hypothetical results: Any performance data, screenshots, statements, or figures shown on our website or marketing materials are hypothetical or illustrative only. They do NOT represent actual trading results
No trading system is infallible. Every trading strategy, methodology, and algorithm — no matter how sophisticated — can and will experience losing trades, drawdown periods, and extended unprofitable streaks
Results vary. Individual results will differ substantially based on account size, broker, spread, commission, slippage, execution speed, market conditions, risk settings, VPS performance, internet connectivity, and other factors

3. Expert Advisor (EA) Specific Risks

Automated trading systems (Expert Advisors) carry unique risks beyond those of manual trading:

Software Errors: Like all software, EAs may contain bugs or behave unexpectedly under certain market conditions not encountered during development or testing
Platform Dependency: EAs depend on the MetaTrader 5 platform, which may experience downtime, updates, bugs, or incompatibilities. EADeck is not responsible for MT5 platform issues
Connectivity Issues: Automated trading requires continuous, reliable internet connectivity. Disconnections, lag, or VPS failures can result in missed trades, duplicated orders, or failure to manage open positions
Broker Compatibility: Different brokers have different spreads, commissions, execution speeds, slippage characteristics, trading hours, and symbol naming conventions. An EA that performs well with one broker may not perform similarly with another
Over-Optimization: Strategy parameters optimized on historical data may be "curve-fitted" to past conditions and fail to perform in future market environments
Market Regime Changes: Markets undergo structural changes over time (regulation, technology, participant composition). A strategy that worked in one regime may cease to work in another
Flash Crashes & Black Swans: Automated systems may not handle extreme market events (flash crashes, gap events, circuit breakers, market halts) appropriately
Execution Differences: Live market execution differs from backtest simulation due to real slippage, requotes, partial fills, and order queue priority

4. Not Investment Advice

EADeck is a software development company. We are NOT:

A registered investment advisor, broker, or dealer
A financial advisor, financial planner, or wealth manager
A licensed trading signal provider
A managed account service or fund manager

Nothing on eadeck.com or in any EADeck product, documentation, or communication should be construed as:

Investment advice or trading recommendations
A solicitation or offer to buy or sell any financial instrument
A guarantee of financial returns or trading outcomes
Personalized financial advice tailored to your individual situation

You should consult with a qualified, licensed financial advisor before making any investment or trading decisions.

5. Your Sole Responsibility

By purchasing and using any EADeck product, you expressly acknowledge and agree that:

You are solely responsible for all trading decisions and their financial consequences
You understand the risks of trading leveraged financial instruments and automated trading systems
You will test any EA on a demo account before deploying it on a live trading account
You will never risk capital you cannot afford to lose
You will configure appropriate risk parameters including position sizes, stop losses, daily loss limits, and maximum drawdown protections
You will monitor your automated trading systems regularly and not assume they will operate without supervision indefinitely
You understand that no EA can anticipate all market conditions and that losses, including total loss of capital, are a real possibility
You will comply with all applicable laws and regulations in your jurisdiction regarding trading, taxation, and financial instruments
You have read and understood the Terms of Service, Privacy Policy, and Refund Policy

6. Hypothetical Performance Disclaimer

CFTC RULE 4.41 — HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN LIMITATIONS.

Unlike an actual performance record, simulated results do not represent actual trading. Also, since the trades have not been executed, the results may have under- or over-compensated for the impact, if any, of certain market factors, such as lack of liquidity.

Simulated trading programs in general are also subject to the fact that they are designed with the benefit of hindsight. No representation is being made that any account will or is likely to achieve profit or losses similar to those shown.

7. Third-Party Risk

EADeck has no control over and assumes no responsibility for:

Your broker's execution quality, policies, financial stability, or regulatory compliance
The MetaTrader 5 platform's reliability, updates, or technical issues
Internet service providers, VPS providers, or any infrastructure you use for trading
Market data feeds, pricing accuracy, or spread variations
Any third-party services, tools, or providers you choose to use in conjunction with our Products

8. Regulatory Notice

Trading regulations vary by jurisdiction. It is your responsibility to determine whether trading foreign exchange, CFDs, gold, indices, or other instruments is legal in your jurisdiction and to comply with all applicable laws, including but not limited to:

Securities and exchange regulations
Tax reporting and payment obligations
Anti-money laundering (AML) and know-your-customer (KYC) requirements
Any restrictions on automated trading, algorithmic trading, or Expert Advisors

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EADECK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

Any trading losses or financial damages of any kind
Any indirect, incidental, consequential, special, exemplary, or punitive damages
Loss of profits, revenue, data, business opportunities, or goodwill
Any damages arising from use of or inability to use any Product
Any damages resulting from unauthorized access to or alteration of your data
Any other losses or damages, regardless of the theory of liability

In no event shall EADeck's total liability exceed the amount you paid for the specific Product giving rise to the claim.

10. Indemnification

You agree to fully indemnify, defend, and hold harmless EADeck and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to:

Your use of any Product
Your trading activities and their financial consequences
Your violation of these Terms or any applicable law
Any claim by a third party related to your use of any Product

11. Acknowledgment

BY PURCHASING OR USING ANY EADECK PRODUCT, YOU ACKNOWLEDGE THAT:

You have read and understood this entire Risk Disclaimer
You understand that trading carries a high level of risk and may result in the loss of your entire capital
You accept full responsibility for all trading decisions and their consequences
You will not hold EADeck liable for any trading losses or damages
No guarantee of profit or performance has been made or implied
You are acting of your own free will and have not been induced by any promise of returns
