        PLEASE READ THESE TERMS CAREFULLY BEFORE PURCHASING OR USING ANY EADECK PRODUCT. By purchasing, downloading, installing, or using any EADeck software product ("Product"), you ("Customer," "You," or "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not purchase or use any Product.
      

1. Definitions

"EADeck" (also "Company," "We," "Us," or "Our") refers to EADeck, the operator of eadeck.com and the creator and seller of the software products described herein.

"Product" means any Expert Advisor (EA), software, source code (.mq5), compiled file (.ex5), documentation, .set files, optimization guides, or any other digital material sold or distributed through eadeck.com.

"Customer" means any individual or entity that purchases, downloads, installs, or otherwise uses any Product.

2. Nature of Products — Digital Software

All Products sold by EADeck are digital software products — specifically, Expert Advisors designed for the MetaTrader 5 (MT5) trading platform. Products are delivered electronically via instant digital download upon confirmation of payment.

Products are automated trading tools that execute pre-defined trading strategies. They are NOT investment advice, financial advisory services, managed account services, signal services, or trading recommendations of any kind.

3. License Grant

3.1 Personal Use License

Upon valid purchase and payment, EADeck grants you a non-exclusive, non-transferable, revocable license to:

Install and use the Product on your own personal MetaTrader 5 trading accounts (unlimited personal accounts)
Access and review the source code (.mq5) for personal study and customization
Receive lifetime updates for the purchased Product(s) at no additional cost

3.2 Restrictions

You may NOT:

Redistribute, resell, sublicense, rent, lease, lend, or share the Product with any third party
Publish, post, upload, or make the Product (or any part thereof, including source code) available on any website, forum, file-sharing service, marketplace, or public repository
Use the Product to create derivative works for commercial sale or distribution
Reverse engineer, decompile, or disassemble the compiled (.ex5) files (source code is provided; this restriction applies only to compiled binaries)
Remove, alter, or obscure any copyright notices, proprietary markings, or attribution within the Product
Use the Product on behalf of or for the benefit of any third party without a separate commercial license agreement
Claim authorship of the Product or represent it as your own creation

3.3 License Termination

This license terminates automatically if you violate any of these Terms. Upon termination, you must immediately cease all use of the Product and delete all copies.

4. No Refund Policy — Digital Products

ALL SALES ARE FINAL. NO REFUNDS WILL BE ISSUED.

Due to the instant digital delivery nature of our Products, all purchases are final and non-refundable. Once the Product has been delivered (downloaded or made accessible), the transaction is complete and cannot be reversed.

By completing a purchase, you expressly acknowledge and agree that:

You are purchasing a digital product that is delivered immediately upon payment
You waive any right of withdrawal, cooling-off period, or refund that might otherwise apply under consumer protection laws, to the maximum extent permitted by applicable law
The non-refundable nature of this transaction was clearly disclosed prior to purchase

5. No Guarantee of Performance or Profit

EADECK MAKES ABSOLUTELY NO GUARANTEES, REPRESENTATIONS, OR WARRANTIES REGARDING TRADING PERFORMANCE, PROFITABILITY, OR FINANCIAL RESULTS.

You expressly acknowledge and agree that:

Past performance (including any backtest results, optimization reports, or historical data) is NOT indicative of future results
No trading strategy, system, or methodology is guaranteed to produce profits or prevent losses
The Products are research and automation tools only — they do NOT constitute investment advice, trading signals, or financial recommendations
All trading involves substantial risk of loss, including the potential loss of your entire invested capital
EADeck is not responsible for any trading losses, damages, or financial consequences resulting from the use of any Product
Results will vary based on market conditions, broker execution, spread, slippage, account size, risk settings, and other factors outside EADeck's control

6. Intellectual Property

All Products, including source code, compiled files, documentation, design, strategy logic, architecture, and any associated materials, are and remain the exclusive intellectual property of EADeck, protected by copyright law and international intellectual property treaties.

The purchase of a Product grants a license to use; it does not transfer ownership of any intellectual property rights.

7. Customer Responsibilities

You are solely responsible for:

Evaluating the suitability of any Product for your trading objectives and risk tolerance
Testing any Product on a demo account before live trading
Configuring appropriate risk parameters, position sizes, and stop losses
Ensuring your trading infrastructure (broker, server, internet connection, VPS) is adequate
Complying with all applicable laws, regulations, and broker terms of service in your jurisdiction
All trading decisions and their financial consequences

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

EADeck's total aggregate liability for any claims arising from or related to any Product shall not exceed the purchase price you paid for that specific Product
EADeck shall NOT be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, trading losses, loss of data, loss of business opportunity, or any other commercial damages, regardless of the theory of liability
EADeck shall NOT be liable for any damages arising from broker errors, platform malfunctions, internet connectivity issues, power failures, or any other circumstances outside EADeck's direct control

9. Disclaimer of Warranties

ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

EADeck does not warrant that any Product will be uninterrupted, error-free, or compatible with every broker, platform version, or trading environment.

10. Indemnification

You agree to indemnify, defend, and hold harmless EADeck, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of any Product, your trading activities, or your violation of these Terms.

11. Modifications to Terms

EADeck reserves the right to modify these Terms at any time. Updated Terms will be posted on eadeck.com with a revised "Last Updated" date. Continued use of any Product after such changes constitutes acceptance of the modified Terms.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which EADeck operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration.

14. Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, and Risk Disclaimer, constitute the entire agreement between you and EADeck regarding the use of our Products and supersede all prior agreements, communications, and understandings.
